BAKERSFIELD, CA – Citing concerns over a series of unfair labor practices as well as employee and patient safety concerns, short-staffing, and low wages, healthcare workers at Kern Medical Center announced the dates of an Unfair Labor Practice (ULP) strike on Thursday, July 7 during a morning press conference and rally. Workers announced that if the Hospital Authority does not meet their demands, they will engage in a three-day unfair labor practice strike beginning on Tuesday, July 26th.

Healthcare workers at Kern Medical Center are urging their employer, KCHA, to settle a contract that ends the staffing crisis at the public hospital by closing the gap in pay with other area hospitals, and to end the illegal unfair labor practices.  A few examples of unfair labor practices that violate KHCA worker rights include refusal to recognize eligible workers in bargaining units, unilateral changes to working conditions, and refusal to provide relevant information to bargain or bargain in good faith.  

The announcement of the ULP strike date comes following a week of voting by Kern Medical healthcare workers made up of Emergency Room Techs, Nurses, Medical Assistants, Sanitation and Nutrition Workers, Patient Transporters, Medical Therapists, and Social Workers, among others overwhelmingly rejecting the Kern County Hospital Authority’s (KHCA) proposal with 96% voting to reject management’s offer and authorize an unfair labor practice strike.

Workers are pointing to the patient care crisis in the public hospital system. Short staffing resulting from the system’s uncompetitive low wages impacts patients, particularly the large number of low-income, medically underserved, underinsured, or uninsured residents.

Rather than offer competitive wage rates to its nursing staff, KCHA management has instead paid exorbitant fees to contractors that supply subcontracted “traveler” nurses [1].  The KCHA management pays the contractors far more than they are willing to pay their own, local, permanent nursing staff. On average, Kern Medical starting wages need to increase by 24.7% to match wages at other hospitals like Mercy [2], and until that happens, the short-staffing and retention crisis will continue. 

Rather than bargain in good faith to address the serious workplace issues that have led to chronic short-staffing, the KCHA management has engaged in a series of Unfair Labor Practices. In May, the Public Employees Relations Board (PERB) issued a proposed order in one such case, which found KCHA management to have violated the rights of multiple employees.  SEIU Local 521 calls on KCHA to comply with the PERB order and cease unfair labor practices. 

Kern Medical Center is the only level 2 trauma hospital between the Grapevine and Fresno.
